By accessing and using the creapal.ro website (hereinafter the "Website"), you expressly and unconditionally accept these Terms & Conditions, as well as the Privacy Policy.

If you do not agree with any of the provisions below, please do not use the Website or our services.

A.G.S CONS SRL, through the CreaPAL.ro platform, offers:

• The design and supply of modular steel structures (containers, modular offices, commercial spaces, residential units, etc.);
• An online configurator for preliminary cost estimation and module configuration;
• Delivery, installation and after-sales service across Romania and the EU;
• Technical and commercial advice via the contact form or by phone.

The information on the site is indicative. Final prices, timelines and technical specifications are set through a personalised quote and a signed contract.

The configurator available at /en/configurator.html is an indicative estimation tool and does not constitute a firm commercial offer.

• The prices generated by the configurator are preliminary estimates and may vary depending on the final specifications, delivery distance, assembly complexity and changes in material costs.
• Submitting a request through the configurator does not constitute a firm order and creates no contractual obligations for either party.
• A.G.S CONS SRL reserves the right to refuse or amend any automatically generated offer, in particular in the case of technical errors or incorrectly displayed prices.
• Using the configurator for unauthorised commercial purposes, automated data scraping or any other use contrary to good practice is prohibited.

No order is considered confirmed without a signed contract and a paid deposit.

• All prices shown on the site are indicative and may be stated excluding VAT; the final price will include VAT under the applicable law.
• Payment is made in Romanian lei (RON), by bank transfer or other methods agreed in the contract.
• Standard payment structure: deposit on signing the contract + balance on delivery/installation (percentages set in the contract).
• Late payments may incur penalties under the contract terms.
• A.G.S CONS SRL issues a tax invoice under Romanian accounting law for all payments received.

• Delivery timelines are estimates and are set in the contract; they may vary depending on the complexity of the order, material availability and weather conditions.
• The client is responsible for ensuring access to the delivery/installation location (access road, level ground, necessary permits).
• The modules are delivered per the contractual specifications; any change to the contract must be agreed in writing.
• The risk of damage to the products transfers to the client from the moment of handover, recorded in the acceptance report.
• Delivery and installation costs are included or separate according to the quote, depending on distance and complexity.

• A.G.S CONS SRL products come with a warranty under the conditions specified in the sales contract and in the attached warranty certificate.
• The warranty covers manufacturing and material defects, under normal use consistent with the intended purpose of the product.
• The warranty does not cover: damage caused by improper use, unauthorised modifications, force majeure, extreme weather events or interventions by unauthorised third parties.
• Service requests should be sent to office@creapal.ro or by phone, with a description of the issue and relevant photos.
• Consumers' legal rights under Law no. 449/2003 and GEO no. 34/2014 are not affected by these conditions.

All content on the Website — including but not limited to: text, images, photos, graphics, logos, videos, the configurator, the visual interface and the source code — is the exclusive property of A.G.S CONS SRL or is used with the consent of the rights holders.

• Reproducing, distributing, modifying or commercially using any content without the prior written consent of A.G.S CONS SRL is prohibited.
• Viewing the content for personal, non-commercial purposes and sharing links to the site pages is permitted.
• The CreaPAL® trademark and associated logos are the property of A.G.S CONS SRL. Their unauthorised use is prohibited.

• A.G.S CONS SRL does not guarantee that the Website will be available uninterrupted or free of technical errors.
• We are not liable for indirect or incidental damages, or damages resulting from the use (or inability to use) the Website or the configurator.
• The Website content is informational; it does not replace specialist technical or legal advice.
• The Website may contain links to third-party sites; A.G.S CONS SRL has no control over them and is not responsible for their content.
• Our contractual liability is limited to the value of the services actually paid for, subject to the exceptions provided by law.

Any disagreement or dispute relating to the use of the Website or our services will be resolved, in order of preference, as follows:

• Amicably: through direct communication at office@creapal.ro or by phone, within 15 days of the dispute arising;
• ANPC: consumers may contact the Romanian National Authority for Consumer Protection (anpc.ro);
• ODR: the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr) is available to EU consumers;
• Courts: if not resolved amicably, disputes are settled by the competent courts of Galați, Romania, under Romanian law.

• These Terms & Conditions are governed by Romanian law, including the provisions of the Civil Code, the Commercial Code, GEO no. 34/2014 on consumer rights and Law no. 365/2002 on electronic commerce.
• A.G.S CONS SRL reserves the right to amend these terms at any time. Changes take effect on the date they are published on the Website.
• Continued use of the Website after changes are published constitutes acceptance of the new terms.
• If any provision of these terms is held void or unenforceable, the remaining provisions remain in force.
